Nuclear, biological and chemical (NBC) weapons and materials (UNSCR 1540)

UN 1540 Committee

The UN 1540 Committee maintains a directory of states, international and regional organizations that have indicated their willingness to assist states lacking the legal and regulatory infrastructure, implementation experience, and/or resources to implement the provisions of the UN Security Council resolution 1540 within their territories.

Verification Research, Training and Information Centre (VERTIC)

On request, VERTIC will assist states to prepare surveys of their existing legislation relevant to NBC treaties, resolutions and other legal instruments, identifying possible gaps where states may usefully take action to meet their NIM obligations; review and comment on draft legislation; conduct awareness-raising activities on NBC weapons obligations for a range of national stakeholders, including departmental officials, parliamentarians, industry, academic and others; and coordinate legislative drafting on NBC weapons legislation among other assistance providers.

VERTIC will offer assistance with legislative drafting specifically for BW obligations in late 2007.

Biological weapons

Advisory Service on International Humanitarian Law, International Committee of the Red Cross (ICRC)

Both the BWC and the CWC are considered to be part of the body of international humanitarian law. The ICRC Advisory Service offers expertise in civil and common law through its Geneva-based headquarters and a team of legal experts based in each continent. Among its primary functions, the Advisory Service offers legal and technical assistance in incorporating IHL into national law. This includes translating IHL treaties, carrying out studies on the compatibility of national law with the obligations arising from these treaties and providing legal advice.

BWC Implementation Support Unit (ISU), Geneva Office, UN Office for Disarmament Affairs (ODA)

The Implementation Support Unit (ISU) will, among other roles, serve as a clearinghouse for information submitted by States to indicate that they are able to offer, or would like to request, assistance with national implementation measures. The ISU became operational in mid-2007.

European Union Joint Action in Support of the Biological and Toxin Weapons Convention (EUJA), Council of the European Union—BTWC Implementation Assistance

Under the Joint Action in support of the Biological and Toxin Weapons Convention (BTWC), the European Union is offering assistance to address the drafting of national legislation implementing the BTWC.  Depending on a state’s requirements, the assistance may also involve: reviewing the completeness of existing national measures; identifying possible gaps in existing national measures; and/or advising on approaches to implementing BTWC obligations through national measures.

Chemical weapons

Office of the Legal Adviser, Organization for the Prohibition of Chemical Weapons (OPCW)

The Office of the Legal Adviser of the OPCW Technical Secretariat has an established programme of legal technical assistance, including examples of comprehensive legislation, models and explanatory documentation. It also comments on draft legislation submitted by states parties. Resources permitting, technical assistance visits can be made to OPCW Headquarters by legislative drafters seeking advice. Additionally, legal experts from states parties and/or the Technical Secretariat routinely assist states parties on-site upon request. The Office of the Legal Adviser also maintains a network of legal experts nominated by states parties. The network includes experts from several international organizations.

International Implementation Assistance Programme (IAP)

The IAP has been jointly established by the governments of Romania and the United States to assist States Parties to establish national authorities and administrative measures to implement the CWC's declaration and export/import requirements.

Legal Services Section, Preparatory Commission for the Comprehensive Nuclear Test Ban Treaty Organization (CTBTO)

The Provisional Technical Secretariat (PTS) of the CTBTO offers implementation advice to authorities in state signatories. The PTS also organizes, on request, seminars and workshops dealing exclusively or in part with national implementation measures and maintains a database of implementation measures taken by states signatories. In order to assist the secretariat in carrying out its programme of assistance, states signatories are encouraged to inform it of the national implementation measures they take.

Office of Legal Affairs, International Atomic Energy Agency (IAEA)

The objectives of the IAEA Office of Legal Affairs legislative assistance programme are to create awareness in member states of the legally binding and non-binding international instruments in the nuclear field; enable member states to comply with their international obligations and commitments; enable member states to establish national legal frameworks governing the safe and peaceful uses of nuclear energy; and transfer relevant knowledge to member states. It covers all branches of nuclear law, in particular nuclear safety; nuclear security; safeguards; and liability for nuclear damage.

The programme is implemented through a multi-faceted approach: holding national and regional training courses and seminars; training individuals; providing bilateral assistance in drafting national laws; and developing reference material for assessing national laws. 

Legislative assistance is provided on request and is available to all member states, regardless of the size of their nuclear programme. It would be of particular benefit to those states which are either in the process of, or seeking to, establish new laws; update existing laws; or consolidate their existing national nuclear legal frameworks.
