Legislation and other databases

Introduction

The databases below include links to legislation and other materials, such as UN 1540 Committee national reports, which states and other interested parties may find useful.

Nuclear, biological and chemical weapons (NBC)

International Committee of the Red Cross (ICRC)

The ICRC database provides documentation and commentaries concerning the implementation of international humanitarian law at the national level. This database is included in the NBC section because it covers, among other topics, legislation and documents relevant to both the BWC and the CWC, which are considered to be part of the body of international humanitarian law. The database includes implementing laws and regulations, national case law and general comments. It is searchable by state or keyword.

The content is drawn from information available to the ICRC Advisory Service on International Humanitarian Law. It illustrates possible approaches to incorporating IHL in national legislation but does not seek to provide a comprehensive picture of the situation.
English is used throughout the database (apart from official texts in French and Spanish, which appear in the original language).

UN 1540 Committee

The UN 1540 Committee maintains two databases. The first is a collection of legislative texts submitted by states to the Committee. The second comprises the national reports that states are required to submit by UNSCR 1540 and other relevant documents submitted by states.

Verification Research, Training and Information Centre (VERTIC)

VERTIC offers two databases relevant to national implementation of NBC treaty and other obligations. The Verification Organizations Directory (VOD) includes contact details for national authorities and focal points for the major NBC treaties, resolutions and other agreements. Where possible, each entry includes contact details and a brief description of its verification-related activities, which may include national implementation roles and responsibilities. You can search the directory in four ways:

Biological weapons

BWC Implementation Support Unit (ISU)

The BWC Implementation Support Unit (ISUA) is based in the UN Office for Disarmament Affairs branch in Geneva. The documents in its database were collected in 2003.

BioSecurityCodes.org

This website is coordinated by the International Futures Program of the Organisation for Economic Co-operation and Development. It has been developed to provide an active resource of global information on oversight mechanisms – particularly codes-of-conduct for the biosciences research community – to help advance these efforts and promote responsible oversight of the biosciences. See Reference: other implementation issues and analysis for information about other resources available from the site.

The database on this site contains a select list of treaties, conventions, laws, policies, regulations, and directives. It is noted in the introduction to the database that as biosecurity is a relatively new and rapidly developing field, many countries have yet to devise or implement biosecurity laws. Since biosecurity has much in common with national security, biosafety, bioterrorism, biological weapons, import / export of dual-use materials, and biodiversity, some countries may develop biosecurity laws by adapting existing laws within these other areas. Therefore, biosecurity legislation as well as laws, treaties, and conventions applicable in other areas that could potentially be used as background for biosecurity legislation are included in the database. Some of the links are to external databases and collections of documents.

It is organized in five sections:

BioWeapons Prevention Project (BWPP)

The BioWeapons Prevention Project (BWPP) is a civil society activity that aims to strengthen the norm against using disease as a weapon.maintains this searchable database. Its searchable database includes source information related to compliance by governments and other entities with the BWC and related norms and treaties.

The Biological and Toxin Weapons Convention Site

This site is maintained by the University of Bradford (UK). Its resources include links to national implementation legislation documents and to related international instruments. See Reference: other implementation issues and analysis for information about other resources available from the site.

Verification Research, Training and Information Centre (VERTIC)

VERTIC offers two databases relevant to national implementation of NBC treaty and other obligations. The database linked below is the ‘Biological Weapons Convention: collection of national implementation legislation’, primarily contains BWC implementing legislation, although legislation on other treaty issues, such as control of pathogens and relevant export controls, has been included where it is available. It was largely compiled in 2003 as part of VERTIC’s project ‘Promoting effective verification of the Biological Weapons Convention’ but has been occasionally updated since then.

International Committee of the Red Cross (ICRC)

Organisation for the Prohibition of Chemical Weapons (OPCW)

The OPCW established its legislation database to assist states with the task of adopting national implementing legislation by providing examples of legislation enacted by States Parties to implement the Chemical Weapons Convention. The examples available were obtained from States Parties which have reported comprehensive implementing legislation (that is, legislation that covers all key areas for enforcement of the Convention), and which have given permission to have their legislation published in the OPCW Legislation Database. In some of those cases, a link has been made to the legislation available on the website of the State Party’s National Authority, in order to ensure that the latest version, including all amendments and supplements, is provided. It also includes links to the OPCW’s 2001 Topical Survey of National Implementing Legislation

Nuclear weapons and materials

International Atomic Energy Agency (IAEA)

The Nuclear Knowledge Management section of the IAEA website offers links to ‘Nuclear Authorities, Governmental Organizations, Laws and Regulations’. (The numbers beside the links refer to the NKM information structure.) Entries are organized by country within each sub-section.

Organisation for Economic Cooperation and Development (OECD)

This OECD web page provides links to country profiles of OECD countries, focusing on nuclear legislation, specifically the regulatory and institutional framework for their nuclear activities.

The OECD rofiles provide comprehensive information on the regulatory and institutional framework governing nuclear activities in each OECD country. Each country profile provides a detailed review of a full range of nuclear law topics such as: mining regime; radioactive substances; nuclear installations; trade in nuclear materials and equipment; radiation protection; radioactive waste management; non-proliferation and physical protection; transport; and nuclear third party liability. Each profile is complemented by reproductions of the primary legislation regulating nuclear activities in the member country.
